 DONATIONS AND BEQUESTS TO THE CHURCH OF IRELAND

The Representative Body of the Church of Ireland was incorporated by Charter to hold property and funds vested in it as trustee for the Church of Ireland. As a permanent trustee body it administers a considerable number of trusts donated or bequeathed for specific church purposes, parishes and dioceses.

While intending donors may have very good reasons for appointing trustees of their own choice there is, nevertheless, considerable advantage in donating, devising or bequeathing in trust to permanent trustees such as the Representative Church Body (or the Church of Ireland Trustees in Belfast) rather than to local trustees, thus avoiding the necessity of appointing new trustees from time to time.

Donations and bequests can be in the form of money, stocks and shares, securities, chattels, houses or lands or the whole or part of the residue of an estate and can be left to the Representative Church Body in trust for the general purposes of the Church of Ireland or in trust for any particular funds of the Church or of any diocese or parish or for any particular church purpose.

Specific bequests and donations are applied by the Representative Body, as they must be, strictly for the purposes declared in the trust instrument or Will and not to any other purpose. However, the Church as a whole is in serious need of unfettered funds to enable it to finance its ongoing responsibilities which include the support and training of new ordinands, the provisions of retirement benefits for clergy and widows and the maintenance of the Ministry generally. Such unfettered donations and bequests to assist the Church as a whole can be given or left to the Representative Church Body in trust, "for such charitable purposes in connection with the Church of Ireland as the Representative Body of the Church of Ireland may from time to time in its absolute discretion approve". This sort of flexibility would enable the Church to apply money to the most urgent and pressing of needs depending on the priorities of the Church from time to time.

The particular form of bequest set out hereafter is suggested with a view to facilitating the administration of funds left to the Church in trust but the Representative Body recommends that a Solicitor be consulted to ensure that bequests made under Will are valid and satisfy legal requirements.

I GIVE, DEVISE AND BEQUEATH …….. [here insert clear particulars of the benefaction ie, a particular sum of money, specific property, a share of the residue etc] to the Representative Body of the Church of Ireland in trust for …….. [here insert clear particulars of the object for which the benefaction is to be applied eg, parochial funds of the parish of …….. in the diocese of …….. or, as a perpetual endowment for the stipend of the incumbent of the parish of …….. in the diocese of …….. or, for such charitable purposes in connection with the Church of Ireland as the Representative Body of the Church of Ireland may from time to time in its absolute discretion approve].

I direct that any funds received by the Representative Body in pursuance of this my Will may be invested in any investments or securities whatsoever in its sole discretion and in all respects as if it were absolutely and beneficially entitled thereto.
