TERMS OF SERVICE
The Church of Ireland Internet Committee of the Central Communications Board is providing World Wide Web page hosting for the benefit of the Church of Ireland. The Internet Committee reserves the right to suspend or cancel a user's access to any or all services provided by the Internet Committee when the Committee decides that the account has been inappropriately used or otherwise.
Personal accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site.
The Internet Committee reserves the right to refuse service and /or access to the servers to anyone.
The Internet Committee do not allow any of the following content to be stored on the servers
Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of the Internet Committee.
Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
HIGH RESOURCE USE POLICY
The Internet Committee may find a user to be utilising server resources to such an extent that he or she may jeopardize server performance and resources for other users. In such instances, the Internet Committee reserves the right to restrict such usage for the benefit of all users.
In this case resource is defined as bandwidth and/or processor utilization.
The Internet Committee may implement the following policy whenever deemed necessary and at its sole discretion
When a website is found to be monopolising the resources available, the Internet Committee reserves the right to suspend that site's internet presence. In most cases the account holder will be informed prior to this action, however, the Internet Committee may act without notice when the resource use is exceptional. Accounts are not intended for multiple downloads or data streaming. Such use may monopolise bandwidth, resulting in site suspension.
In the event of suspension it is unlikely that the affected site will be re-enabled without a significant change to it's content or use.
The Internet Committee reserves the right to change prices at any time. Payment is due on receipt of an invoice. Any account not brought current within a week of e-mail notice or exceeding this time frame in any way is subject to suspension. No bills or invoices will be sent by regular mail. The user is responsible for all money owed on the account from the time it was established to the time that the user notifies the Internet Committee in writing for a request for termination of services.
The Internet Committee reserves the right to cancel service at any time. All fees paid in advance of cancellation will be prorated and repaid by the Internet Committee if the Internet Committee institutes its right of cancellation. If cancellation is caused by users violation of these policies, then no refund is due.
Users can cancel service any time and be refunded any amount exceeding the prepayment of the current month. Payment will be made by cheque within 30 days of receipt of cancellation. The account will be cancelled at the end of the current billing period, unless a date of cancellation is specified.
The user agrees that he or she shall defend, indemnify, save and hold the Internet Committee and/or the Church of Ireland harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against the Internet Committee, its agents, its users, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by user, its agents, employees or assigns. The user agrees to defend, indemnify and hold harmless the Internet Committee and/or the Church of Ireland against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with the Internet Committee' server; (2) any material supplied by user infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to user from the Internet Committee' server.
Neither the Internet Committee nor the Church of Ireland will be responsible for any damages your business may suffer. Neither the Internet Committee nor the Church of Ireland makes warranties of any kind, expressed or implied for services we provide. The Internet Committee and the Church of Ireland disclaim any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, or wrong delivery. The Internet Committee reserves the right to revise its policies at any time.
